Louisiana Electrical & A/C Service LLC (LES)
(Louisiana use only)

The scope of Louisiana Electrical & A/C Service LLC’s (“LES”) work shall be defined by an Estimate attached to or incorporated into this agreement. LES agrees to commence work as authorized by the Estimate. Work includes all labor and materials necessary or incidental to completing the job in compliance with this agreement and all applicable laws, regulations, and ordinances.

1.01 Approval of any Estimate is also an agreement to these Terms and Conditions.

In consideration for services performed, the customer agrees to pay LES the full amount due as defined in the Estimate.

2.01 Payment is due upon completion of services, or at a time otherwise agreed, but no later than 30 days from job completion.
2.02 NSF Checks: All returned checks incur a fee not to exceed $25.00 or 5% of the face amount, whichever is greater.
2.03 Late Payments: Invoices not paid within 30 days accrue interest at 1.5% per month (18% annually) or the maximum allowed by Louisiana law.
2.04 Lien Rights: LES reserves the right to file a Statement of Claim or Privilege under Louisiana Revised Statutes §9:4801 if payment is not received as agreed.

LES shall provide services in a timely manner consistent with industry standards.

Any alterations, deviations from the Estimate, or concealed/unforeseeable conditions that require additional labor or material shall be authorized by verbal, written, or electronic order and will be billed as an extra charge in addition to the contract price.

Any increase or decrease in LES’s scope of work must be documented as a change order. Change orders may be authorized by the customer through written, verbal, or electronic means (including email or text message). Customer understands that any approved change order will result in an adjustment to the contract price and/or timeline. LES will not perform extra work without customer approval.

LES warrants that all workmanship performed shall be free from defects caused by faulty labor for a period of one (1) year from the completion date.

LES does not warrant materials, equipment, or parts supplied, other than as required by law. All material and equipment warranties are limited to the manufacturer’s warranty, if available. LES will assist the customer in processing manufacturer warranty claims when applicable.

In addition, LES provides a one (1) year labor warranty on new HVAC system installations. This labor warranty covers the cost of labor for replacement of manufacturer-approved defective parts. Extended labor warranties may be available for purchase.

This warranty is in addition to, and not in place of, any manufacturer warranties.

If customer breaches this agreement, LES may, upon written notice, suspend or terminate services.

Customer acknowledges review and acceptance of the Estimate as sufficient for the described services.

Workmanship, equipment, and materials shall be as specified and to the satisfaction of LES.

LES will obtain and pay for required electrical/mechanical permits unless otherwise agreed in writing. The customer is responsible for zoning, building, or non-trade permits unless specified.

LES may subcontract portions of the work as needed. LES remains responsible for the quality and compliance of subcontracted work.

Customer is responsible for identifying underground pipes, conduits, cables, tanks, or structures prior to work. LES shall not be liable for damage to concealed or undisclosed utilities not identified in plans or walkthroughs. Customer agrees to indemnify LES for losses caused by undisclosed underground conditions.

This document represents the entire agreement. No verbal agreements or prior communications modify this contract. Any changes must be in writing and signed by LES.

If LES pursues collection or litigation arising from this agreement, customer shall pay LES’s reasonable attorney fees and court costs, not less than $1,500, regardless of fee schedules.

This agreement is governed by the laws of Louisiana. Any legal disputes shall be resolved exclusively in Iberia Parish, Louisiana.

LES is not liable for delays or failures caused by events beyond its control, including hurricanes, floods, accidents, pandemics, terrorism, or utility interruptions. LES will use reasonable efforts to resume performance promptly.

LES performs Generac warranty services as an independent provider. All warranty claims are subject to manufacturer approval. If denied, partially denied, or unpaid, customer remains fully responsible for labor, parts, and service costs, due upon notification.

All invoices are subject to Louisiana state and applicable parish sales taxes.

Coverage:

• LES will replace any capacitor installed by us, free of charge (parts and labor), for the lifetime of the HVAC unit.
   
• “Lifetime” means the manufacturer’s expected serviceable life of the unit.
   

Requirements:

• Customer must be continuously enrolled in LES’s Maintenance Agreement Program.
   
• Recommended preventative repairs must be approved.
   
• Capacitor must be installed by LES.
   
• Warranty is non-transferable unless:
   
  • New owner enrolls in the Maintenance Program within 30 days, AND
     
  • $50 transfer fee is paid.
     

Exclusions:

• Pre-existing system issues
   
• Failures not related to capacitors
   
• Electronics (defrost boards, control boards, etc.)
   
• Discontinued/unavailable parts
   
• Systems not in Maintenance Program (30-day grace period)
   

Notice:
If a repair is not covered under this warranty, standard rates apply (trip charges, refrigerant, diagnostics, after-hours, EPA fees).
